The Code of Urbanism The Community of Saint Martin organized on Thursday 04 last December at the CCISM a major consultation meeting to discuss with the population the main lines of the new Urbanism Code of Saint Martin. This meeting ended the consultation period before the code was put to the vote, the 18 December in the territorial council, to be definitively adopted.
The December 4 consultation meeting was chaired by Senator Guillaume Arnell, 1er Vice-President in charge of Sustainable Development of the Community, under whose authority the new Saint-Martin Urban Planning Code was implemented. Jean-Marie Duprat, in charge of the mission to the Vice-President Guillaume Arnell, was entrusted with the drafting of the code, but also with the Local Planning Plan (PLU). Department of Planning and Urban Development led by Ronald Gunot.
Philippe Baffert, consultant for the Collectivity, in charge of drafting the new code, was with Guillaume Arnell to explain the issues and to provide the public with all the necessary clarifications to understand this new document and the many areas it covers In urban planning.
All the elected members of the Territorial Council were invited to this meeting, as were the professionals concerned with urban planning law and the general public. It was a question of presenting the code and the changes made to the national code that served as the basis for the drafting of the code of St. Martin.
"We wanted a simplified code, clear, accessible and adapted to the specificities of our territory, so that it constitutes a real leverage for a mastered town planning," explained Senator Guillaume Arnell, specifying that this code will also allow a better respect of the Rules of urban planning in Saint-Martin.
The Town Planning Code of Saint-Martin is a document much more digestible than the national code - a hundred pages at most - organized in six books, each with several chapters. In some respects, the code of Saint-Martin takes the rules of the national code, this is the case for the code of heritage, the code of the environment and the European directives on wetlands for example.
On the other hand, the code of Saint-Martin has been simplified in terms of right of expiry, or urban consolidation. A significant change has also been made in the area of ​​construction, planning and demolition, particularly with regard to the compulsory use of an architect.
The code will still be the subject of some arbitration, before being submitted to the vote of the territorial council of 18 December 2014, for a definitive adoption.
The Town Planning Code therefore defines the urban planning rules of a territory; it is the support of laws on which a community relies to develop its territory, and it is the PLU, a more political document, which fixes the ambitions and the future projects of this territory. Just like the Town Planning Code, the Saint-Martin PLU - which will be finalized in 2015 - is not a fixed document; both can be amended or modified at any time.
