Swimming conditions
The staff of the Environment and Community Living Branch of Saint-Martin once again observed, on Tuesday 24 February 2015, the deterioration of information panels installed on the territory by the Community. From Bay to Plums to Orient Bay, via Friar's Bay and Grandes Cayes Bay, numerous signs informing the public about the conditions of bathing on the territory of the Community have been vandalized. These informative signs, whose installation is compulsory and regulated by law, play a crucial role in protecting and informing the general public. The Community decided to file a complaint against X to the gendarmerie for vandalism on public property. Its services are also obliged to systematically replace damaged panels, which represents a significant cost for the public finances, and therefore for the taxpayer (460 euros for the change of a sign). The Community of Saint-Martin strongly denounces these acts of incivility which affect all the citizens and tourists who frequent the beaches of the territory and asks the perpetrators to stop deteriorating the public good at the risk of being Prosecuted in court. Swimming on our beaches, what does the law say? The obligations of the Community differ according to whether there is a place for bathing or a free place of bathing. However, in both cases, the jurisprudence has identified two major principles that govern the exercise of police power by the mayor: - The community must report the dangers; - The Collective must take all the preventive measures required by the organization of the relief in the event of an accident. When swimming is not monitored but frequented regularly during part of the year, arrangements must be made to allow rapid intervention in the event of an accident. Among these provisions, the proximity of a telephone set and the presence of emergency buoys at sea are compulsory. In all cases, the community must inform the public of the prohibitions and conditions of practice of the nautical activities by appropriate publicity in the community and at the bathing places. An information panel is installed on each of the 16 beaches of the territory.
