In an international context marked by the departure of French nationals - some of them minors - to areas of conflict, the Parliament wished to establish a system of prior authorization for the exit from France of minors (Article 49 of Law No. 2016- 731 of 3 June 2016, codified in article 371-6 of the civil code).
From 15 January 2017, any minor who travels abroad without being accompanied by an adult with parental authority, must be provided with an authorization to leave the country.
In the case of a trip abroad, the minor must be provided with his / her identity document (national identity card or passport), an authorization to leave the territory signed by a person having parental authority And a photocopy of the identity document of the legal guardian who signed the exit authorization (Decree No. 2016-1483 of 2 November 2016). The use of the passport alone is no longer considered sufficient.
The authorization to leave the territory will be due for all minors residing in France, whatever their nationality.
This new system complements the judicial measures (prohibition of exit from the territory) and administrative measures of urgency (oppositions to the exit of the territory) making it possible to avoid a possible departure abroad.
The exit authorization form will be accessible on www.service-public.fr. In the event of a false declaration, the signatory of the authorization is subject to the sanctions of articles 441-6 and 441-7 of the penal code.
