Decisions of the Executive Council of March 4, 2026
The executive council is a decision-making body that deliberates on the current affairs of the Collectivité ranging from the allocation of subsidies to associations to the allocation of exceptional aid and scholarships, to work permits for foreigners, to the use or occupation of land (AOT, building permit, etc.) or even to the exercise of the urban pre-emption right.
During the Executive Council meeting of March 4, 2026, 5 resolutions were examined.
• Resolution approving amended building permit No. 971127 2501014 M01, for the benefit of Mr. Olivier KLEINHANS
By deliberation CE 110-06-2025 of June 19, 2025, the executive council took note of the building permit tacitly acquired on May 24, 2025, registered under reference PC 971127 2501014, relating to the construction of six T3 type dwellings on a plot located on the Leonel Bertin Maurice boulevard, in Grand-Case.
Following the legality check carried out by the Prefect of Saint-Barthélemy and Saint-Martin, several observations were made, one of which concerned the conformity of the project to article UB 7 paragraph 3 of the land use plan (POS).
After adversarial proceedings and legal analysis, the Collectivité adopted resolution CE 122-11-2025 of October 9, 2025, granting a derogation to article UB 7 paragraph 3 of the POS, on the basis of point 3 of article 15-5 of the Town Planning Code of Saint-Martin.
In order to formally integrate this derogation into the initial permit and to administratively secure the authorization, the petitioner submitted, on October 23, 2025, an amendment building permit registered under reference PC 971127 2501014 M01.
The Executive Council decides to approve the amended building permit, filed on October 23, 2025, which aims to integrate into the tacit building permit no. 971127 2501014 the exemption granted by the aforementioned deliberation CE 122-11-2025.
• Culture/visual education: Membership of the Collectivité of Saint-Martin in the association "L'Archipel des lucioles"
In 2025, the Collectivité launched the national "Passeurs d'images" program for the first time, designed to promote access to cinema and media literacy for audiences with limited cultural engagement. This initial implementation required specific methodological, artistic, and partnership support.
The association L'Archipel des Lucioles plays a central role in this area by supporting communities and the coordination of the Passeurs d'images scheme, providing expertise, educational resources, networking of actors and support for the structuring of projects.
With a view to ensuring the sustainability and development of the system in 2026, the Collectivité 's membership in this association appears to be an essential lever for consolidating the actions undertaken.
Joining the "L'Archipel des Lucioles" association addresses several strategic issues for the Collectivité :
• Structure and secure the local coordination of the Passeurs d'images system, recently deployed in the Territory;
• Benefit from expert support in media literacy, programming, training and project methodology;
• Strengthen the quality and consistency of actions carried out with the public, in particular
young people and audiences who are far removed from cultural offerings;
• To permanently integrate media literacy into the cultural and educational policy of the Collectivité ;
• To join a national network of professionals, promoting the exchange of practices, the pooling of tools and the skills development of local actors.
The Executive Council decides to approve the membership of the Collectivité of Saint-Martin in the association "L'archipel des lucioles" for the year 2026 and approves the amount of the annual membership fee set, in 2026, at twenty euros.
· Decision relating to the extension of a work permit for intervention of foreign labor of the company Kormarine Engine Service LLC with the Société Electricité de France (EDF) for the benefit of seven specialized technician workers, of South Korean nationality, in occasional maintenance intervention.
In support of a tripartite transactional memorandum of understanding signed with HYUNDAI Heavy Industries (HY) and BOUYGUES Energies & Services, the company Electricité de France EDF, represented by Mr. Pierre-Yves GILLOT, Head of the Northern Islands department, was authorized by resolution of the Executive Council dated September 25, 2025 (No. CE 120-01-2025), to organize the entry into the territory of 12 foreign specialized technicians including nine (9) South Koreans, as part of a major maintenance operation of the engines of the EDF power plant.
Ongoing since October 5, 2025, these large-scale and highly technical works are still ongoing. Difficulties related to the complexity of the operations have caused delays and require the continued presence of personnel on site, as their technical expertise remains essential to maintaining sufficient electricity production within the territory of the Collectivité.

Given the scale of the work remaining to be done on the main engines of the power plant, EDF is now requesting the extension of the travel and work authorization for seven foreign specialist technicians.
The Executive Council decides to issue a favorable decision on the renewal application.
