    Decisions of the Executive Council of September 18, 2025

    The executive council is a decision-making body which deliberates on the day-to-day affairs of the Collectivité, ranging from the allocation of subsidies to associations to the allocation of exceptional aid and study grants, to work permits for foreigners, to the use or occupation of land (AOT, building permits, etc.) or even to the exercise of the right of urban pre-emption.

    During the Executive Council meeting of September 18, 2025, 6 deliberations were examined.

    · Review of transfer declarations subject to statutory pre-emption rights and filed between July 17, 2025 and July 25, 2025.

     

    The examination of land applications is an administrative procedure for examining applications concerning land use. This procedure, specific to the statutory right of pre-emption (DPS), aims to:

    • Regulate land transfers in order to preserve the general interest of the Collectivité ;

    • Ensure sustainable land management in line with urban development objectives; and this, in line with the “Urban Planning” competence of the Collectivité ;

    • Preserve natural spaces and fight against land speculation;

    • Ensure access to housing for the inhabitants of Saint-Martin; and this, in accordance with the requirements of the PLH of the Collectivité (2025-2030), adopted in October 2024.

    The review in question specifically concerns transfer declarations subject to the statutory right of pre-emption, filed between July 17, 2025 and July 25, 2025. A total of 48 files were examined.

    After analysis, the Collectivité does not exercise its statutory right of pre-emption.

    The Executive Council decides to approve the notice submitted, relating to transfer declarations subject to the statutory right of pre-emption, filed between July 17, 2025 and July 25, 2025

     

    · Review of transfer declarations subject to statutory pre-emption rights, filed between August 25, 2025 and August 29, 2025.

     

    The examination of land applications is an administrative procedure aimed at examining applications concerning land use. This procedure is specific to the statutory right of pre-emption.

    (DPS) aims to:

    • Regulate land transfers in order to preserve the general interest of the Collectivité ;

    • Ensure sustainable land management in line with urban development objectives; and this, in line with the “Urban Planning” competence of the Collectivité ;

    • Preserve natural spaces and fight against land speculation;

    • Ensure access to housing for the inhabitants of Saint-Martin; and this, in accordance with the requirements of the PLH of the Collectivité (2025-2030), adopted in October 2024.

    The review in question specifically concerns transfer declarations subject to the statutory right of pre-emption, filed between August 25, 2025 and August 29, 2025. A total of 16 files were examined.

    After analysis, the Collectivité does not exercise its statutory right of pre-emption.

    The Executive Council decides to approve the opinions submitted, relating to transfer declarations subject to the statutory right of pre-emption, filed between August 25, 2025 and August 29, 2025.

    · Review of applications for declaration of intent to alienate subject to urban pre-emption rights, filed between July 17, 2025 and July 25, 2025.

     

    The processing of these requests constitutes an essential step for the management of the territory and the urban development of the Collectivité. The challenges of this procedure are multiple and include:

    • The implementation of a coherent heritage strategy in alignment with the urbanization and land development needs of the territory.

    • The development of accessible housing adapted to the needs of the population.

    • The fight against land speculation and the preservation of local land heritage.

    • The creation of infrastructure and collective equipment to promote sustainable development of the territory.

    • The protection of natural and built spaces in order to ensure a balance between urbanization and environmental conservation.

    The review in question concerns applications for intent to alienate filed between July 17, 2025 and July 25, 2025. A total of 10 files were examined.

    After analysis, the Collectivité did not exercise its urban pre-emption right for any of them.

    The Executive Council decides to approve the notices relating to declarations of intent to alienate filed between July 17, 2025 and July 25, 2025.

    · Review of applications for declarations of intent to alienate subject to urban pre-emption rights, filed between August 25, 2025 and August 29, 2025.
