    Decisions of the Executive Council of September 29, 2025

    The executive council is a decision-making body which deliberates on the day-to-day affairs of the Collectivité, ranging from the allocation of subsidies to associations to the allocation of exceptional aid and study grants, to work permits for foreigners, to the use or occupation of land (AOT, building permits, etc.) or even to the exercise of the right of urban pre-emption.

    During the Executive Council meeting of September 29, 2025, 23 deliberations were examined.

    · ESF+ global grants 2021-2027

    The outermost region of Saint Martin has obtained, for the 2021-2027 programming, an allocation of €20.85 million from the European Social Fund Plus (compared to €16,596,204.39 between 2014 and 2020). Of this total, the Collectivité manages, as an intermediary body, a global grant of €15.1 million under priorities 2, 3 and 7 of the National ESF+ 2021-2027 Programme "Employment, Inclusion, Youth and Skills".

    As a reminder, the ESF+ grant agreement for the 2021-2027 programming was signed on November 20, 2024 by the President of the Territorial Council and on December 18, 2024 by the Guadeloupe regional prefect.

    The actions co-financed under the global grant must make it possible to achieve the objectives

    specific to the following 3 priorities:

    • Priority 2: Promote access to employment for young people and strengthen their employability, particularly through educational success (youth employment)

    • Priority 3: Improve skills and education and training systems to better support economic changes

    • Priority 7: Responding to the specific challenges of the outermost regions

    The Collectivité has thus launched a call for projects, with an ESF+ budget of €822,946, under priority 7 and specific objective A, on the theme of "Improving access to employment and activation measures for all job seekers, particularly young people - OR (GUADOI1038)"; and this for the first half of 2024.

    8 applications for European aid from companies, cooperatives, associations, groups or administrations were examined. Following the instruction phase, the internal selection committee of the Collectivité consulted in writing between July 16 and 24, 2025 issued unfavorable opinions, either because the project leader abandoned the operation, or because the amount was lower than the threshold of €50,000 required, or because the file was placed on the wrong call for projects, or because the file was incomplete despite reminders.

    The Executive Council decides to reject the ESF+ grant applications submitted in view of the reasons given in the opinion of the programming committee.

     

    · Review of planning permission applications

     

    8 points related to the planning permission process, an administrative process responsible for reviewing applications relating to land use and construction in a given area. This process aims to ensure that construction, renovation, or development projects comply with the rules of the land use plan and the Saint-Martin natural risk prevention plan.

    · Review of transfer declarations subject to statutory pre-emption rights, filed between July 29, 2025 and August 7, 2025.

     

    The examination of land applications is an administrative procedure for examining applications concerning land use. This procedure, specific to the statutory right of pre-emption (DPS), aims to:

    • Regulate land transfers in order to preserve the general interest of the Collectivité ;

    • Ensure sustainable land management in line with urban development objectives; and this, in line with the “Urban Planning” competence of the Collectivité ;

    • Preserve natural spaces and fight against land speculation;

    • Ensure access to housing for the inhabitants of Saint-Martin; and this, in accordance with the requirements of the PLH of the Collectivité (2025-2030), adopted in October 2024.

    The review in question specifically concerns transfer declarations subject to the statutory right of pre-emption, filed between July 29, 2025 and August 7, 2025. In total, 22 files were examined.

    After analysis, the Collectivité does not exercise its statutory right of pre-emption.
