    Decisions of the Executive Council of February 9, 2026

    The executive council is a decision-making body that deliberates on the current affairs of the Collectivité ranging from the allocation of subsidies to associations to the allocation of exceptional aid and scholarships, to work permits for foreigners, to the use or occupation of land (AOT, building permit, etc.) or even to the exercise of the urban pre-emption right.

    During the Executive Council meeting of February 9, 2026, 2 resolutions were examined.

    Exercise, by the Collectivité, of the statutory right of pre-emption for the acquisition of plot AI 111

     

    The heavily urbanized Marigot watershed is exposed to major flood risks, exacerbated by the inadequacy of existing hydraulic infrastructure. The Marigot 2024 Stormwater Master Plan (SDEP), integrated into the 2024-2026 Flood Prevention Action Plan (PAPI), identified the need to create a new structure to cross Rue de Hollande, in order to divert some of the stormwater towards the Galisbay Canal.

    The area in question has a proven vulnerability to flooding, exacerbated by the saturation of existing structures and the impossibility of resizing the Durat Bridge due to its heritage value.

    Under these conditions, the acquisition of plot AI111 constitutes a prerequisite for the realization of this structuring development, included in the Flood Prevention Action Plan (PAPI) 2024-2026: the realization of the works being carried out within the framework of the PAPI within an estimated period of 2 to 3 years.

    This acquisition makes the Collectivité eligible for national funding schemes dedicated to the prevention of natural risks, which are fully applicable to Saint-Martin: Green Fund and FPRNM (Major Natural Risk Prevention Fund, known as "Barnier Fund").

    It is therefore appropriate for the Collectivité , under these conditions, to exercise its statutory right of pre-emption.

    The Executive Council decides to authorise the acquisition of plot AI111, located in Galisbay, 97150 Saint-Martin, with an area of ​​982 m², for an amount of €350,000.00.

    · Delegation for Living Environment and Ecological Transition – allocation of subsidies to environmental associations for the year 2025, approval of objectives and means agreements and authorization for signature by the President of the territorial council.

    The Department of Ecological Transition is continuing its structuring to increase its expertise in the fields of the environment, waste management, and ecological transition. It is crucial that this effort and investment by the Collectivité in this area receives support from civil society in order to achieve overall territorial performance commensurate with the challenges, which are:

    - The identification, land control and management of natural areas;

    - Raising public awareness about the environment/nature;

    - Acceptance of the reality of climate change and the need to prepare for/adapt to it;

    - The involvement of civil society in the popularization and dissemination of scientific knowledge;

    - The structuring of the environmental professions sectors (training, employability, reality of opportunities);

    - The acquisition of sufficient knowledge in terms of engineering to broaden the scope of funding sources (National and European schemes).

    Eight associations have requested support from the Collectivité . The analysis of the files led the Commission for Living Environment and Ecological Transition to issue a favorable opinion for six of them on July 31, 2025, with qualitative, diversified and inclusive projects which tend to demonstrate that, faced with anthropogenic constraints on natural environments and climatic constraints, Saint-Martin civil society is organizing itself and integrating these aspects into its desire to carry out projects.

    These requests also make it possible today to support the co-managing associations (alongside the Collectivité) of sites known as the Conservatoire du Littoral, located outside the perimeter of the Saint-Martin National Nature Reserve.

    The Executive Council decides to approve the allocation of subsidies from the Collectivité to the following four environmental associations for a total amount of €170,000.00; for the 2025 financial year:

    - ACED Association (€5,000.00);

    - Association for the Management of the Saint-Martin National Nature Reserve (€30,000.00);

    - Soualiga Animal Lovers Association (€10,000.00);

    - Association Nature is The Key - Wellness, Entertainment & Solidarity (€125,000.00).

    The council approves the agreements on objectives and resources and, consequently, authorizes the President of the territorial council to sign said agreements with the following two associations:

    - Association for the Management of the Saint-Martin National Nature Reserve;

    - Nature Is The Key Association - Wellness, Entertainment & Solidarity.

    The council refuses to grant subsidies to the four other environmental associations, mainly due to the land status, the legitimacy of the project or the lack of co-financing of the projects.
