Decisions of the Executive Council of October 9, 2025

The executive council is a decision-making body which deliberates on the day-to-day affairs of the Collectivité , ranging from the allocation of subsidies to associations, to the allocation of exceptional aid and study grants, to work permits for foreigners, without forgetting the use or occupation of public property (AOT, building permits, etc.) or even the exercise of the right of urban pre-emption.

During the Executive Council meeting of Thursday, October 9, 2025, 18 deliberations were examined.

· Allocation of an exceptional investment grant from the Collectivité to the Public Industrial and Commercial Establishment (EPIC) called ELITE for the acquisition of equipment necessary for the reopening of the slaughterhouse, and approval of the related agreement for the 2025 financial year.

In accordance with Articles L. 2224-1 and L. 2224-2 of the CGCT, communities may not, except in exceptional circumstances,

finance a SPIC from their own budget. However, Article L. 2224-2 provides for three exceptional cases allowing such financial support:

1. When the requirements of public service lead the collectivité to impose specific operating constraints;

2. When the operation of the public service requires the making of investments which, due to their importance and having regard to the number of users, cannot be financed without an excessive increase in tariffs;

3. When, after the period of price regulation, the removal of any support from the municipal budget would result in an excessive increase in prices.

In this respect, it is up to the Collectivité , by deliberative means, to:

1. Present the context for the allocation of the subsidy based on Article L. 2224-2 of the CGCT, under the exceptional health constraints imposed by the State (formal notice from the prefect of 22/11/2023) and the regulatory and health constraints specific to slaughterhouses and their activities

2. Detail the calculation methods, which in this case are based on the investment program in charge of the EPIC ELITE to which the mission of management and operation of the building (slaughterhouse and cutting workshop) has been entrusted;

3. Determine the payment terms, taking into account financial requirements;

The investment program covered by the EPIC amounts to €88,671.10 including tax and is distributed as follows.

The Executive Council of October 9th decided to approve the payment, by the Collectivité, of an exceptional investment grant to the Public Industrial and Commercial Establishment (EPIC) called ELITE for the 2025 financial year; said grant being intended to finance the equipment expenditure necessary for the reopening of the Saint-Martin slaughterhouse and the structure's cutting workshop.

The Council also sets, in line with the aforementioned resolution CE 110-16-2025, the amount of said subsidy at €57,466.61, the total investment program for the year 2025 being €88,671.1.

It also approves the draft “Agreement 2025 - Exceptional Investment Grant” drawn up between the Collectivité and EPIC ELITE, this document defining the purpose, reciprocal commitments, terms of allocation, payment and control.

· Authorization to sign an agreement for the provision of premises between the Collectivité and the public industrial and commercial establishment ELITE (Establishment for innovation and agro-processing through Excellence – Saint-Martin Slaughterhouse).

The collectivité owns the Saint-Martin slaughterhouse located at 98 Rue Franklin Laurence - Millrum Grand-Case - 97150 Saint Martin.

The public establishment for the management and operation of the Saint-Martin slaughterhouse (EGEA) was authorized to occupy it by agreement signed on July 1, 2022 and expiring on June 30, 2025.

As part of the Territorial Plan for Sustainable Agriculture, and with the aim of economic diversification, renovation and upgrading work on the slaughterhouse building, as well as the construction of an extension allowing the cutting and processing of meat products, were carried out.

In view of the expansion of its scope of action, the Public Industrial and Commercial Establishment of the Collectivité, manager of the slaughterhouse, has modified its statutes and changed its name, to now be called ELITE, Establishment for Innovation and Agro-Transformation through Excellence.

The executive council decides to approve the occupation of the Saint-Martin slaughterhouse and cutting workshop building located at 98 Rue Franklin Laurence - Millrum Grand-Case by the Establishment for Innovation and Agro-Transformation through Excellence (ELITE), for a period of 5 years, starting from the signing of the provision agreement between the Collectivité and the Establishment cited in the subject.

· Payment, by the Collectivité, of the 2024 and 2025 contributions of the Conference of Regions

The Collectivité de Saint-Martin has been a member of the Conference of Peripheral Maritime Regions of Europe (CPMR) since January 2019. This association is governed by the French law of July 1, 1901, and is composed of 160 European regions from 24 Member States of the European Union (EU) and beyond. Since its creation in 1973, the CPMR has worked to defend the interests of its member regions so that they are taken into account in all EU policies with a significant territorial impact.
